These notices shall satisfy two separate but related procedural requirements for activities to be undertaken by the California Department of Housing and Community Development (HCD).
On or about October 28, 2025, the California State Department of Housing and Community Development (HCD) will submit a request to the U.S. Department of Housing and Urban Development for the release of $9,708,129 of Home Investment Partnerships Program (HOME) funds under Title II of the Cranston-Gonzales National Affordable Housing Act of 1990, as amended, for a project located adjacent to 1050 E. Street in Crescent City, California (APN #s 118-440-021-000, and -022-000), for the purpose of partially funding the rehabilitation of a 162-unit affordable housing project in Crescent City, CA.
The Battery Point Apartments proposes to develop 162 units of affordable housing on a 4.9-acre site comprised of two adjacent parcels, with no address assigned, adjacent to 1050 E Street, in Crescent City, Del Norte County, California 95531. The site is currently vacant. The project will construct 121 units of family housing in a four- and five-story building with 144 parking spaces; and 41 units of senior housing in a four-story building with 21 parking spaces. The unit mix will be 54 one-bedroom units, 63 two-bedroom units, 29 three-bedroom units and 16 four-bedroom units for a total of 162 residential units and 165 parking spaces. The project will be divided into two parcels, one with affordable family apartments, and one with affordable senior apartments. The project will be constructed using steel modular units that will be manufactured off-site and assembled on-site. The project will be affordable to families and seniors earning between 30 and 70 percent of Del Norte County Area Median Income (AMI).
Projected sources of federal funding include HOME Program- $9,708,129 (the request for this notice); CalHFA Tax-Exempt- $16,375,000 and CalHFA MIP- $4,000,000.
HCD has determined that the project will have no significant impact on the human environment. Therefore, an Environmental Impact Statement under the National Environmental Policy Act of 1969 is not required. Additional project information is contained in the Environmental Review Record (ERR). The ERR will be made available to the public for review either electronically or by U.S. mail. Please submit your request by email to NEPAComments@hcd.ca.gov.
Any individual, group, or agency may submit written comments on the ERR to HCD by emailing NEPAComments@hcd.ca.gov Attn: Jason Bradley. All comments received by October 27, 2025, will be considered by HCD prior to authorizing submission of a request for release of funds. Comments should specify which Notice they are addressing.
HCD certifies to HUD that Jason Bradley, Project Origination Branch Chief in their capacity consents to accept the jurisdiction of the Federal Courts if an action is brought to enforce responsibilities in relation to the environmental review process and that these responsibilities have been satisfied. HUD’s approval of the certification satisfies its responsibilities under NEPA and related laws and authorities and allows the HCD to use HOME funds.
HUD will accept objections to its release of fund and HCD’s certification for a period of fifteen days following the anticipated submission date or its actual receipt of the request (whichever is later) only if they are on one of the following bases: (a) the certification was not executed by the Certifying Officer of HCD; (b) HCD has omitted a step or failed to make a decision or finding required by HUD regulations at 24 CFR part 58; (c) the grant recipient or other participants in the development process have committed funds, incurred costs or undertaken activities not authorized by 24 CFR Part 58 before approval of a release of funds by HUD; or (d) another Federal agency acting pursuant to 40 CFR Part 1504 has submitted a written finding that the project is unsatisfactory from the standpoint of environmental quality. Objections must be prepared and submitted in accordance with the required procedures (24 CFR Part 58, Sec. 58.76) and shall be emailed to RROFSFRO@hud.gov or mailed to HUD San Francisco Regional Office, One Sansome Street, Suite 1200, San Francisco, CA 94104. Potential objectors should contact HUD at the above address to verify the actual last day of the objection period.
